Watch Jon Stewart With Betsy McCaughey - Stewart Has The Patience Of A Saint

Jon Stewart at The Daily Show does a fine job of staying ahead of McCaughey. Her arguments are not very robust and neither are Stewart's but he is a comedian. His arguments are more than sufficient to handle McCaughey's fear based misrepresentations.

McCaughey
does come off as awfully condescending. Throwing out that she has a Phd and saying about Stewart, "Isn't he cute" as he is making his point (I think she did this twice. Perhap one time she called him funny not cute).

McCaughey sounds very disingenuous and came across as a paranoid. Stewart is an incredibly patient man.

As a lawyer who used to work for AARP and dealt with private plans that have even more aggressive wording in contracts, i just have to say, she is such a liar, to say nothing of nonsensical. (By the way, im also angry because my sister's pregnancy, even though she has maternity coverage, cost $30,000! Yes, she's covered but regardless she was denied coverage even though she paid for it! As someone who is strictly PRO-LIFE, if anything, this would incentivize more abortions!) But back to the main topic..

I mean, if someone has a health care directive, of course they want it enforced (DUH, why have it?) but if they change their mind and revoke it, that too is to be enforced. What a dumbsh*t. Furthermore, no one is required to have advance directives. If you want advance directives, you do not even have to involve your doctor. Many people make up a living will by themselves or with just a lawyer. None of that will be changed by this, or any bill that gets passed. My understanding (which could be wrong) is that the main proposal here is simply that doctors will be able to get reimbursement for time they spend consulting with patients about advance directives. End-of-life choices are still completely up to each individual; this just makes it easier for people to get their doctor's input, if that is what they want.

That's the reason the bill offers to reimburse every five years, so that the patient can reassess or update their living will, and make an updated decision. It actually allows for more frequent updating in the face of a serious change in health, too.

I just want to add: "creation of and adherence to orders for life-sustaining treatment" is the wording in the bill. McCaughey is lying if she interprets that as the complete opposite of what it says.

To break this complex sentence down, and dumb-down the big words for the reading-comprehension-impaired, there are two parts to it:

Part 1:
Create orders for medical care to keep people alive.

Part 2:
Follow orders for medical care to keep people alive.

Also she said doctors were going to be rewarded for "forcing" patients to adhere to these living wills or advance directives even if the patient changed their mind or the family wanted something different.

The legislation protects patients both ways, which she did not understand. It requires adherence to living wills, but there's nothing inherent in this term or in the term "end-of-life care" that means death. Some patients may explicitly say they want life-sustaining care like IV nutrition or to be resuscitated.

The doctor is penalized for not following the patient's wishes--regardless of which direction that takes.

I completely agree with Joan. Her main argument was not that people shouldn't have advanced directives, but rather that people who get one that's essentially a DNE when they're healthy might change their mind when they're sick. This bill would encourage doctors to convince patients to adhere to the advanced directives that they signed when of sound mind and body. That doesn't seem particularly controversial to me...as Joan said, why have one if you don't want it enforced? For those people who want to change their advanced directives when they are sick, they can certainly still do so under this bill.

I don't think there's any question that McCaughey is quite intelligent, which means that she understands the incentive structure laid out in the bill. However, she is also an ideologue, and that makes her inclined to spin the bill's meaning to suit her politics. This is the worst kind of pundit: someone who knowingly argues in a disingenous way in order to reinforce their cause.
